Pool Policy
This Guest Safety and Pool / Ocean Waiver forms an integral part of the Terms & Conditions of stay at Shanti Sands.
1. General Safety Acknowledgement
The Guest acknowledges that Shanti Sands is a private holiday residence located in a natural coastal environment. The property includes, but is not limited to, swimming pools, terraces, stairs, uneven surfaces, beachfront access, ocean exposure, wildlife, insects, weather-related hazards, and marine conditions.
The Guest voluntarily assumes all risks of injury, illness, loss, damage, or death arising from occupation or use of the property.
2. Swimming Pool Disclaimer
The swimming pool is unattended at all times.
No lifeguard, safety officer, or medical personnel are provided.
All swimming and use of the pool facilities is entirely at the Guest’s own risk.
Children and non-swimmers must be supervised at all times by a responsible adult.
3. Ocean & Beachfront Risk
The ocean environment is inherently dangerous and unpredictable.
Risks include strong currents, tides, marine life, sharp objects, weather changes, and drowning.
Shanti Sands provides no supervision, safety equipment, or rescue services for ocean activities.
Guests enter the ocean entirely at their own risk.
4. Medical Fitness & Responsibility
The Guest confirms that all occupants are medically and physically fit to travel and stay at the property.
The Guest assumes full responsibility for medical treatment, evacuation, hospitalization, or repatriation costs.
Shanti Sands accepts no responsibility for providing medical assistance or insurance coverage.
5. Release & Waiver of Liability
To the maximum extent permitted by law, the Guest hereby releases, waives, and discharges Shanti Sands, its owners, directors, management, employees, contractors, and agents from any and all claims, liabilities, losses, damages, or causes of action arising from injury, illness, accident, or death occurring on the property or surrounding areas.
6. Indemnity
The Guest agrees to indemnify and hold harmless Shanti Sands from any claims, actions, damages, losses, legal costs, or liabilities arising from:
- The Guest’s stay or use of the property
- Acts or omissions of the Guest or their invitees
- Injury or damage caused to third parties
This indemnity survives the termination of the stay.
7. Acknowledgement & Acceptance
By booking, checking in, or occupying the property, the Guest confirms that they have read, understood, and voluntarily accepted this Guest Safety & Pool / Ocean Waiver on behalf of themselves and all occupants and visitors.
